By Logging in the website www.pmlholidays.com, the user hereby certify and confirm that he/she is bound by the following terms & conditions :-
1. Applicability:
a. www.pmlholidays.com is a web application owned and operated by PAUL MERCHANTS LTD (PML) to facilitate offering travel services like Air Ticket / Hotels / Holiday Packages / Travel insurance / Recharges & E Commerce to the travelers who intend to book the services for their travel needs. The services are provided from its user interface www.pmlholidays.com and the same can also be made available through its sales office / head office and/or franchisee office.
2. User Obligations:
a. By availing services through www.pmlholidays.com, the user accepts the terms and conditions including but not limited to Price details , Rules, Penalties, Refunds documentation required against the transaction made on PML Holidays. All services rendered are different from each other; hence specific rules of each transaction will apply. In case of any conflict, the present terms and conditions will prevail. PML Holidays reserves the right to use the email Id / mobile number or any other personal information supplied by the user to send the itinerary details and or send special promotions from time to time.
b. PML grants to the user a limited, non-transferable right to use the Website in accordance with the terms and conditions of this Agreement. The user shall use the Website to make legitimate reservations or purchases and shall not use the Website for any other purposes, including without limitation, to make any speculative, false or fraudulent reservation or any reservation in anticipation of demand. User hereby undertakes to use the Website only for lawful purpose and shall fully indemnify PML against any and all losses which PML may suffer on account user usage of the Website and/or any services/products of PML.
c. The user shall be solely responsible for maintaining the confidentiality of its password and account information. The user may not authorize any third parties to use the services on its behalf, and shall be responsible for all actual or purported use by the user and those allowed by the user to use the services. The user may not divulge, sublicense, transfer, sell or assign its password and account information under any circumstances. Any attempt to do so shall be null and void and shall be considered a material breach of this Agreement.
d. The user shall be solely responsible for all usage or activity on its account including, but not limited to, use of the account by any person who uses its password and account information, with or without authorization by the user. If the user has reason to believe that its account is no longer secure (for example, in the event of a loss, theft or unauthorized disclosure or use of its password and account information), it must promptly change the affected password and account information and notify PML of the problem by e- mailing it. It is however clarified that the user shall be fully liable for all use of its account, including any unauthorized use of its account by any third-party. All bookings made by utilizing the Website through the login and password shall be as per the terms and conditions prescribed by PML from time to time
3. Foreign Exchange transactions:
a. While making payments in foreign currency, the user hereby undertakes and confirms that he has complied with all applicable rules and regulations/ guidelines prescribed by RBI from time to time. PML Holidays holds no responsibility for any kind of violation or irregularity committed by the USER.
4. Online Payments:
a. By booking any transaction through payment gateway options, you irrevocably authorize and allow PML Holidays and its employees /agents like banks and representatives designated by them to retrieve, use, store your relevant information/data at all times.
b. For any transaction made through debit/credit card online, the responsibility of the same shall always rest upon you and PML Holidays will have no answerability/liability /responsibility for any type of misuse/excess payment /wrong payment and false debit etc.
5. Service Charges:
a. PML Holidays reserves the right to add a service fee to the published fare on the website and once confirmed it will be the responsibility of the USER to pay all charges, fees, taxes arising out of each transaction. All commercial terms and conditions are subject to change solely at the discretion of PML Holidays without any notice. The user understands and confirms that this stipulation is fair considering the unique circumstances of travel trade.
6. Refunds and Cancellation:
a. By intimating PML Holidays, the USER can cancel the booking at least 48 hours prior to departure. However all cancellations shall be subject to refund policy of the company as applicable from time to time. In addition to it the PML Holidays imposes a service fee which shall be deducted upon refund of the applicable amount.
b. The user is advised to enquire about the company’s refund policy at the time of booking.
7. Limitation of Liability:
a. We are a travel arrangement company and don’t own or operate any airlines/ hotels/ transport or any other service of our own. PML Holidays is a source for providing the relevant travel options as per requirement of the traveler and in no case does it hold the liability/ responsibility of authenticity/ quality and the credibility of services provided by respective service providers. The traveler will be governed by the applicable laws of the land in respect of immigration, visa and customs while travelling. PML Holidays is not responsible on these accounts in any manner whatsoever.
b. In case of force majeure, natural calamities, climatic conditions, labor unrest, insolvency, business exigencies, government decisions, operational and technical issues, unscheduled and sudden route & flight cancellations, PML Holidays will hold no responsibility /liability. However PML Holidays will put all possible efforts to make suitable alternate arrangements fully at the cost of traveler. In situations beyond the control of PML Holidays, it is likely that services committed earlier may be altered. In all such cases, travelers hereby give his consent to abide by the cancellation / refund policy of the concerned service provider.
8. Proprietary Rights:
a. All the material / information available on PML Holidays are the sole property of Paul Merchants Limited. You will not misuse or copy the data furnished on this site at any time. Any such notification brought to the notice of PML Holidays attracts the legal consequences. PML Holidays reserves the right to edit / change and remove any content from the website at any time without any prior notice. Any kind of transmission performed on website is never completely secured. The data transmitted to PML Holidays may also be accessible by its agent partners and affiliates.
b. Any kind of unauthorized copying or misuse of data/information supplied on portal is illegal and is subject to law of land.

18. Disclaimer:
a. The content available on website may be changed / amended withdrawn for further improvement or for any other reason at any time solely at the discretion of PML Holidays.
19. Jurisdiction:
a. All disputes arising here from will be subject to exclusive jurisdiction of courts at Chandigarh.
a. PML Holidays reserves the right to refuse any booking made by the user for any reasons fully as per its own discretion and PML Holidays holds no responsibility to disclose the reasons.

a) The the user shall not while working for PML, act as an agent or sub agent or PSA of any other Company/Entity/Organization for offering travel related services
b) The user agrees on its own behalf, and on the behalf of its affiliates, subsidiaries, employees, officers and directors, that neither it nor they will, for one year after its expiration or termination as sub agent, act as an agent/sub agent/PSA for any other Company/Entity/Organization for offering travel related services.
21. That the details on the products/services, terms & conditions governing their sale and the user’s commission/revenue is given in Schedule I to this agreement which will form an integral part of this agreement. PML reserves the right to change the products/services and the terms governing sale, commission/revenue thereof at any time at its sole discretion and the user shall have no objection for the same.
22. That the user will bear all types of taxes and statutory levies as are applicable or which may become applicable at a later stage, to the service offered by the user under this agreement.
23. PML will be entitled to set off any outstanding amount due from the user at any point of time and the the user shall have no objection for the same.
24. That in offering the Services to the general public, the the user shall ensure that it complies with all applicable laws and regulations and shall be solely and exclusively responsible for any liability whatsoever, arising out of any violation done by it directly or indirectly of any Rule, Regulation, Provision or Guideline prescribed under any applicable Statute and PML shall not be responsible in any manner whatsoever.
25. The user shall hold all monies related to the services offered by it on behalf of PML in trust for PML. The user shall make sure that any amount received by it from the customers shall be remitted to PML without any delay. In respect of transactions entered into by the user with the customers, the user shall be solely responsible for the financial aspects of the transaction/deals and PML shall recover all considerations only from the user without having any need to deal with the customer directly for this purpose.
26. The user shall use its best efforts to advertise and promote the Services so as to evoke maximum public interest and shall use the Promotional Materials in consultation with PML. Upon the request of PML, the user shall cease advertising or engaging in any other form of promotion which, in the opinion of PML in its absolute discretion, is considered to be harmful or adverse to the business or business reputation of PML.
27. PML shall provide all necessary guidance to the user for the purpose of offering the services under the agreement and the user will make sure while offering these services to the public, all guidelines, instructions and rules as prescribed by PML are strictly followed by the user.
28. That while making payment of overseas vendors, the user shall make sure to verify the original passport of the traveler and shall provide the copy of the same along with A2 form signed by the traveler. The responsibility of getting this needful done will be solely on the user and PML shall always rely upon the documents provided by the user as to its authenticity and correctness. In case of any irregularity in KYC and other documents of the traveler, supplied by the user, the whole responsibility and answerability for the same will be on the user without any involvement of PML.
29. The user shall maintain full records of business done by it on behalf of PML and PML shall always have right to inspect and take copies of such records maintained by the user.
30. The user shall not at any time during the term of this agreement, or at any time thereafter, use for its own or another party’s advantage, or disclose to any other party, the terms of this agreement, information relating to the products/services of the Company or any trade secrets of Company in any manner whatsoever.
31. The user assumes all risks and losses arising from or in connection with offering the Service under this agreement. The user shall indemnify and keep indemnified PML against any liability, cost, judgment, penalty, fine or the like, including, but not limited to, reasonable legal fees sustained or paid by PML by way of suit, claim, damages, settlement or otherwise as a result of any act or omission by the user, its employees or agents in connection with offering the services under this agreement.
32. The user acknowledges and agrees that all trade names, trademarks, service marks, copyright and other property rights of PML will remain the exclusive property of PML. The user shall not assert any claim in respect of any such property rights during the Term of this agreement or thereafter.
33. That the user acknowledges and agrees that PML is not obliged to continue the user as its sub agent and may terminate/suspend the user as its sub agent at any time without liability to the user. In case the user fails to observe or perform any of its obligations under the terms of this agreement or is found to be involved in any activity which is against the law of land, PML will have the right to terminate or suspend this agreement immediately and in that event the security deposit kept by the user with PML shall stand forfeited in favour of PML.
34. That notwithstanding anything contained elsewhere in this agreement, PML may also suspend/ terminate this agreement by giving 30 days written notice to the user if PML is not satisfied with the performance of the user or it is deemed undesirable to continue this agreement for any reason whatsoever.
35. That all notices in connection with this agreement shall be in writing and shall be delivered to the receiving party at the address of the party as stated above.
36. That after termination of the agreement for any reason, the user shall immediately remove or permit PML to remove, all signs, displays or other materials containing PML name or logo and shall immediately cease to hold itself out as providing the Services on behalf of PML.
37. That this agreement, including its schedule any documents it refers to, constitute the whole agreement between the user and PML with respect to the offering of the Services and supersedes any previous agreements or understandings between the parties.
38. That any dispute arising between the parties to this agreement will be subject to the exclusive jurisdiction of the Courts of Union Territory of Chandigarh.
SCHEDULE 1
All the below mentioned products/services are subject to full payment in advance before the release thereof , value of services to be limited to the extent of advance received.
1. Air Tickets
a. The Company will offer the sub agent, full range of Air Ticketing options with best possible deals and prices. The amount of services offered will not be more than the credit value in your account.
2. Hotels and Holiday Packages
a. We have a complete range of hotel accommodations to be offered to passengers which is available on our web application as well as with our offline product development team, which are suitable for all type of clientele, ranging from budget to deluxe 5 star accommodations. A Tour package will be prepared as per the specific needs of the passenger on case to case basis. All these hotels are available on Pre Payment.
3. Worldwide / Overseas Hotels
a. Under this category, we are doing all the major chains in all the major cities around the world with hotels ranging from one star to five star deluxe accommodations. There are approx. 30,000 hotels that can be booked through us. You will find all the major hotel groups like Hyatt, Hilton, Holiday Inn, Crown Plaza etc. under the pre payment category. The entire payment for the properties on pre payment has to be made in India in USD, Euro or GBP out of the BTQ or LERMS entitlement of the passenger as per RBI norms along with the statutory documents required in this regard. We would be giving you a specific deadline for the booking by which you would have to make the payment failing which we would have to release the booking.
4. Reservation and Payments
a. Pre Payment: We would be sending you the net rates as per your requirements. All the payment for hotels booked on pre payment basis has been made here in USD or GBP or EURO out of the BTQ or LERMS entitlement of the passenger. Please note that all payments along with copy of passport, Form A2 duly signed by customer (signature should match with copy of passport), and air ticket have to reach our office failing which we would not be able to send the vouchers to you.
5. Overseas Travel Insurance
a. In association with Future Generali, PAUL MERCHANTS LTD brings Overseas Travel Insurance to your doorstep offline. With the backing of one of the world’s biggest insurance company & India’s biggest corporate house, the whole process of issuance of policies & claim of refunds has been simplified. We can offer single trip or annual multi-trip policies.
b. Reservations: You can get Insurance Policies from our office. We provide online policy facility & a range of options to choose from.
c. Payments: Payments for all Insurance can be made in Indian Rupees (for Foreigners without work permits or residence permit, no insurance can be done).
d. Commissions:
e. All rates quoted on system and offline are net rates subject to change as per teh dynamic availability. TDS will be deducted where applicable. Payments against all bookings should reach our office before release of Vouchers/ Air tickets

7. Confirmations:
a. As far as the confirmations of the bookings are concerned, we have online and offline procedures for all our products which are confirmed through e-mail only. All confirmations will be intimated through Email/ Fax and all online confirmations are as per the system.
8. Collaterals:
a. We would also be sending you the collaterals for all our products as per the requirement.
b. We would be sending your Collaterals on the execution of the agreement. While corresponding with us, please mention your company name, your city name & your affiliate status with our organization.
c. All the terms, conditions including rates, fare, cancellation charges etc. are subject to change at any time and without any prior notice. The company will not have any liability / answerability for any such eventuality.
d. It is expressly provided that company is not the actual supplier of the service/ products mentioned in this agreement and is only a facilitator of the services. Thus for any deficiency in services provided by the actual supplier, the company will not be liable in any circumstances.
